Emerging litigation threat: Reg E Compliance
In May 2018, the League first alerted you of a nationwide litigation threat regarding overdraft practices and programs. In June 2018, the first Ohio credit union received a demand letter from a D.C. law firm threatening a lawsuit in state court regarding an alleged lack of adherence to internal policies and disclosures for overdraft fees under Reg E. Nearly a year later, in March 2019, a second Ohio credit union received a demand letter from the same D.C. law firm making similar allegations.
